Shanghai: SMPG announces Draft Data Regulations

The Shanghai Municipal People's Government ('SMPG') requested, on 30 September 2021, public comments on the new Shanghai Draft Data Regulations. In particular, the SMPG noted that the formulation of the Draft Regulations as a comprehensive local data regulation is important for implementing national laws such as the Data Security Law ('DSL') and Personal Information Protection Law ('PIPL'). Furthermore, the SMPG outlined the content of the Draft Regulations cover matters including:

  • protection of data rights;
  • public data;
  • opening and application of data resources; and
  • data security (using the framework of the DSL).

More specifically, the SMPG highlighted the Draft Regulations provisions on data reform of the Pudong New Area on issues including cross-border data flow, and international data port construction. In addition, the SMPG detailed the Draft Regulation mentions data cooperation in the Yangtze River Delta and the promotion of the establishment of a cross-regional data objective verification and processing mechanism.
