Russia: Roskomnadzor issues summary of data protection legislative changes

The Federal Service for Supervision of Communications, Information Technology and Mass Communications ('Roskomnadzor') issued, on 11 August 2022, a summary of legislative changes affecting personal data at a meeting of the Public Council under the Roskomnadzor. In particular, the Roskomnadzor highlighted that the Federal Law of 14 July 2022 No. 266-FZ on Amending the Federal Law on Personal Data ('the Amendment Law') enters into force on 1 September 2022. More specifically, the Roskomnadzor outlined that data operators are required to notify the Roskomnadzor of data leaks of user information under the Amendment Law, and that processing of personal data is only possible under contract where there are no conditions restricting a person's right to control their personal data.

In addition, the Roskomnadzor stated that further improvement of legislation relating to personal data was required, including among other things, the need for tougher penalties for leaking or illegal processing personal data. Furthermore, the Roskomnadzor detailed the need for greater liability from the illegal processing of personal data, including the recognition of such processing as a criminal act.
