Russia: Roskomnadzor issues recommendations on online advertising

On November 22, 2023, the Federal Service for Supervision of Communications, Information Technology, and Mass Media (Roskomnadzor) published recommendations to assist organizations in complying with the requirements of the Federal Law of 13 March 2006 No. 38-FZ On Advertising (the Law on Advertising).

What are the key recommendations?

The Roskomnadzor noted that the Law on Advertising requires organizations to label online advertising and notify the Roskomnadzor about placing advertisements.

In particular, the recommendations provide details on:

  • how to generate an advertising identifier;
  • how to add the identifier to different media of online advertisements (such as video, podcast, or text); and
  • how to solve common errors in the process.

What are the penalties for non-compliance?

The Roskomnadzor highlighted that, since September 2023, the following fines are in place for lack of labeling online advertising and failure to provide information:

  • from RUB 10,000 (approx. $110) to RUB 100,000 (approx. $1,130) for individuals;
  • from RUB 30,000 (approx. $340) to RUB 200,000 (approx. $2,270) for officials;
  • from RUB 200,000 (approx. $2,270) to RUB 500,000 (approx. $5,674) for legal entities.
