Republic of North Macedonia: DZLP issues statement on data protection and Coronavirus
The Directorate for Personal Data Protection ('DZLP') issued, on 16 March 2020, its statement ('the Statement') on data protection in light of COVID-19 ('Coronavirus'). In particular, the Statement outlines that processing carried out for matters of public interest, including protection against serious cross-border health threats is a legal basis for processing data under Articles 10 and 13 of the Law on Personal Data Protection 2020. Moreover, it is also lawful to process health data even when the person is not physically or legally capable of giving consent, especially when it comes to emergency situations, in order to safeguard their essential and vital interests. In addition, the Statement highlights the transparency, data security, and accountability requirements that must be upheld. Lastly, the Statement includes a short section on frequently asked questions and answers on Coronavirus and employment.
