Quebec: CAI updates guidance for private companies

On September 21, 2023, the Quebec Commission on Access to Information (CAI) updated its guidance page for private organizations. The guidance page examines, among other things, the scope of the Act Respecting the Protection of Personal Information in the Private Sector as amended by the Act to modernize legislative provisions as regards the protection of personal information (formerly known as Bill 64). In addition, the guidance page provides specific information on topics including:

  • accountability;
  • Privacy Impact Assessment (PIA);
  • consent;
  • destruction and anonymization;
  • anonymization and depersonalization;
  • privacy incidents involving personal information; and
  • biometrics.

With recent amendments to its guidance on PIAs, collection by technological means, and penalties for non-compliance.
