Puerto Rico: DACO requests public comments on draft regulation for commercial practices
The Department of Consumer Affairs of Puerto Rico ('DACO') published, on 1 October 2019, a public request for comments on its draft regulation for commercial practices ('the Draft Regulation'), which includes a chapter on deceptive practices and advertisements through telemarketing. In particular, the Draft Regulation prohibits telemarketing companies from, among other things, submitting any charge to a bank account or credit card of a consumer without authorisation by the consumer, or to request any sort of incentive in order to remove negative information from a credit history. Moreover, the Draft Regulation requires telemarketing companies to keep an exact register of individuals who have expressed their wish not to receive advertisements by telephone, and copies of authorisations received from consumers.
