Philippines: National Privacy Commission Releases Circular Amending 2021 Rules of Procedure

On January 26, 2024, the National Privacy Commission (NPC) announced via LinkedIn the release of NPC Circular No. 2024-01, which modifies specific provisions outlined in its 2021 Rules of Procedure. This circular introduces new definitions for terms such as 'compliance check,' 'privacy sweep,' and 'public authority.' Notably, Circular No. 2024-01 brings amendments to Section 5, stating, 'The Commission is authorized to utilize its enforcement powers under the Data Privacy Act (DPA) during investigations to mandate cooperation from the subjects under inquiry, as well as other involved individuals or entities, including public authorities. This is done to compel necessary actions for the protection of the interests of data subjects.' Additionally, the circular grants the NPC the authority to conduct proactive and systematic compliance checks on various data processing activities.

Circular No. 2024-01 is set to take effect on February 10, 2024.
