Peru: ANPD approves RIPD guide and MCCs for data transfers with new resolution
The National Authority for the Protection of Personal Data ('ANPD') announced, on 25 October 2022, that it had approved its Directorial Resolution No. 0074-2022-JUS/DGTAIPD, which allows for the implementation of the Ibero-American Data Protection Network ('RIPD') model contractual clauses ('MCCs') for the international transfer of personal data. In particular, the ANPD outlined that the MCCs are included within the guide for the implementation of MCCs for the international transfer of personal data, released in October 2022.
Furthermore, the guide intends to overcome limitations in international data transfers, and contribute to transfers being carried out under conditions that safeguard the right of data owners, in accordance with Law No. 29.733 on the Protection of Personal Data 2011 and Supreme Decree No. 003-2013-JUS which Approves the Regulation of Law No. 29.733.
