Oklahoma: House Committee on Technology introduces amendments to Computer Data Privacy Act

The House Committee on Technology ('the Committee') voted, on 16 February 2022, 6-0 to advance House Bill ('HB') 2969 for the Oklahoma Computer Data Privacy Act and introduced amendments to the original text. In particular, HB 2969 would now provide for a higher monetary threshold for applicability, meaning that covered entities would now need to have an annual gross revenue of $15 million instead of $10 million for the provisions of the bill to apply. Moreover, HB 2969, as amended, would prohibit businesses from collecting a consumer's personal information directly from the consumer prior to notifying the consumer of each category of personal information to be collected and the purposes for which information will be used, as well as obtaining the consumer's consent. 

Furthermore, HB 2969 outlines the consumers' right of access, of deletion, and to opt out of the sale of their personal information by a business, nonetheless providing that the use of a method of strictly opting out for data privacy is ineffective and might pose an immediate risk to health, safety, and welfare, thus aiming towards a model more focused on an opt-in, rather than an opt-out method.

HB 2969 will now move to the House floor for third reading and potential passage out of chamber.
