Norway: Datatilsynet makes statement on data transfers post Brexit
The Norwegian data protection authority ('Datatilsynet') published, on 4 December 2020, a statement on the transfer of personal data to the UK after Brexit. In particular, Datatislynet noted that if the European Commission gives the UK an adequacy decision before 2021, companies do not need to take any action with regard to the transfer of personal data. In addition, the Datatilsynet highlighted that if the Commission does not give the UK an adequacy decision before 2021, companies that transfer personal data to the UK must ensure a transfer mechanism and comply with the supplementary measures, as established by the Data Protection Commissioner v. Facebook Ireland Limited, Maximillian Schrems (C-311/18) ('the Schrems II Case') ruling if they are to continue transferring personal data to the UK after 31 December 2020.
