North Rhine-Westphalia: LDI NRW warns against law allowing police search using AI

On September 3, 2024, the North Rhine-Westphalia State Commissioner for Data Protection and Freedom of Information (LDI NRW) warned against a draft law that, among other things, provides new search options for the federal police and the federal criminal police office, including to search the internet for images and photos of suspects using artificial intelligence (AI). 

LDI NRW noted that although the draft law is limited to the federal police authorities, several state premiers have welcomed the expansion of search powers. LDI NRW advised to not ignore data protection and citizens' right to privacy, stating, among other things, that it is necessary to describe precise and narrow limits for such a search tool under which mass collection of data in public spaces can be made possible as the privacy of many innocent people is also affected.
