North Rhine-Westphalia: LDI NRW issues guidelines for online exams at universities

The North Rhine-Westphalia State Commissioner for Data Protection and Freedom of Information ('LDI NRW') published, on 28 July 2022, guidelines for online exams at universities. More specifically, LDI NRW outlined that the guidelines are intended to clarify the limits of video-based supervision in relation to the protection of the privacy of examinees and to address critical issues such as the recording of exams.

Moreover, the LDI NRW provided a non-exhaustive list of the possible measures for conducting online examinations and examined their admissibility. Separately, the LDI NRW also highlighted that, in general, in order to assess a measure, the following aspects must be taken into account:

  • purposes for video surveillance;
  • proportionality of the measure; and
  • comparison with face-to-face exams.
