North Carolina: Bill relating to use of minors' data for advertising introduced to House

House Bill 644, for the Social Media Algorithmic Control in IT Act, was introduced, on 17 April 2023, to the North Carolina House of Representatives, and thereafter referred, on 24 April 2023, to the Judiciary Committee, after its first reading. In particular, the bill would set out obligations for operators of social media platforms.

Notably, the bill would establish special protections for users who are minors, requiring that user data be used in algorithmic recommendations only when the user has been notified and has consented to the use of the data in such a manner. Furthermore, the bill would require the platform to be fully functional for users without the user having to give consent for their data to be used to inform algorithmic recommendations.

Lastly, the bill would set out that social media platform's privacy policies must be accessible on the platform's website and that they must disclose how user data will be used by the platform, provided in a succinct and easy-to-understand manner that communicates the true intent of data use in less than 250 words.
