North Carolina: Bill for the North Carolina Consumer Privacy Act introduced to Senate

Senate Bill 525, A bill to be entitled An act to protect consumers by enacting the Consumer Privacy Act of North Carolina, was introduced, on 3 April 2023, to the North Carolina State Senate, and thereafter referred, on 4 April 2023, to the Committee on Rules and Operations of the Senate, after its first reading. In particular, the bill would set out various consumer rights, including the right to access, deletion, portability, and opt out of certain processing, and the principles of transparency, purpose specification, non-discrimination, and data minimisation.

Furthermore, the bill provides that any violation of its provisions would not provide a basis for a private right of action, and that the Attorney General would have the exclusive authority to enforce it.

Finally, the bill would take effect on 1 January 2024.
