New York: NYDFS releases investigative report of Facebook privacy practices

The New York State Department of Financial Services ('NYDFS') announced, on 18 February 2021, that the New York State Governor had accepted an NYDFS report detailing the findings of an investigation into the transmission of sensitive user data by application and website designers to Facebook, Inc. In particular, the report:

  • summarises the roles of the Facebook entities involved and discusses how Facebook obtains data from third-party app developers;
  • provides a brief overview of the NYDFS' investigation and discusses the extent to which Facebook cooperated with the NYDFS' inquiries;
  • outlines the remedial measures that Facebook has undertaken as a result of the NYDFS' investigation to address the privacy issues implicated; and 
  • provides the NYDFS' recommendations for ongoing and additional remediation of the various concerns described in the report.
