Netherlands: Ministry opens public consultation on Data Protection Collective Act
The Ministry of Justice and Security ('the Ministry') opened, on 20 May 2020, a public consultation on the Data Protection Collective Act ('the Act'), including amendments to the Act Implementing the General Data Protection Regulation (Regulation (EU) 2016/679)('GDPR') and other laws, such as the Whistleblowers Authority Act, in order to update legislation in line with data protection law. In particular, Act includes, among other things, clarifications of the permissions of the legal representative. For example, Article 5(3) of the Act clarifies that a data subject who has reached the age of 12 may revoke consent to data processing at any time. Furthermore, the Act amends Article 23 to add a further exception to the prohibition of processing special categories of personal data if the processing is necessary for an accountant to perform compulsory audits.
