Netherlands: AP rejects Fraudehelpdesk's permit application to process criminal data

The Dutch data protection authority ('AP') announced, on 26 October 2021, that it has rejected the permit application of Stichting Aanpak Financieel-Economic Crime in the Netherlands ('SafeCin'), trading as Fraudehelpdesk, to process criminal data. In particular, the AP noted that the Fraudehelpdesk is not allowed to collect and store data about possible perpetrators of fraud as it is not an investigative agency and does not need this criminal information for its task. Moreover, the AP emphasised if the Fraudehelpdesk was to be permitted to process criminal data, individuals can be wrongly labelled as fraudsters.
