Netherlands: AP assesses proposal for amendments to Telecommunications Act
The Dutch data protection authority ('AP') announced, on 20 May 2020, its assessment of the Cabinet's proposal to amend the Telecommunications Act to allow for the sharing of telecommunications data to combat the COVID-19 ('Coronavirus') pandemic. In particular, the AP outlined that it will publish its findings when the Cabinet will publish the legislative proposal and that it will clarify if the advice of the AP is insufficiently incorporated. However, the AP indicated that the processing of telecommunications data is not permitted under current legislation and that anonymisation of data is not possible in practice.
