Netherlands: ACM publishes DSA guidelines for providers of online services

On September 12, 2024, the Authority for Consumer and Markets (ACM) published Guidelines on the Digital Services Act (DSA) for providers of online services. This follows a public consultation on the guidelines on the DSA in January 2024.

In particular, the ACM highlighted that the Guidelines clarify obligations set out under the DSA for online intermediary services. The ACM is the relevant authority for compliance with the DSA in the Netherlands. Specifically, the Guidelines outline how online intermediary services may comply with:

  • content moderation;
  • accessibility and communication;
  • influencing customers through dark patterns and advertising;
  • the protection of minors; and
  • business-to-consumer (B2C) online marketplaces.
