Montenegro: AZLP initiates supervision procedure on private health institution and Health Insurance Fund of Montenegro

The Agency for Personal Data Protection and Free Access to Information ('AZLP') announced, on 30 September 2021, that it had initiated a supervision procedure in relation to the private health institution 'Codra' and the Health Insurance Fund of Montenegro. In particular, the AZLP's decision came after media coverage of two criminal charges filed against the acting director of the Health Insurance Fund, one of which alleged that he had taken more than 50 medical records from Codra without the knowledge of the hospital or patients, and sent them to Serbia for testing.

Notably, the AZLP highlighted that the initiative was launched to assess whether unlawful processing of personal data had taken place, noting that the personal data was of special category.
