Mongolia: Draft cybersecurity law submitted to Parliament

OneTrust DataGuidance confirmed, on 4 July 2021, with Erdenedalai Odkhuu, Partner at Melville Erdenedalai LLP, that a draft cybersecurity law was submitted to the Mongolian Parliament on 30 June 2021. In particular, Erdenedalai noted that the draft law is divided into five sections and 25 articles, which address namely:

  • the aims of the draft law, the laws that form cybersecurity legislation, application of the draft law, definitions, and principles (Section 1);
  • the main directions of cybersecurity activities (Section 2);
  • the cybersecurity system and the powers and liabilities of government bodies, such as the State Great Khural, the Cabinet of Mongolia, and state administrative bodies in charge of information and communications (Section 3);
  • the coordination of cyber attack and conflict control centres and their functions (Section 4); and
  • matters related to the supervision of cybersecurity activities, sanctions for violation of the draft law, and the effective date of the draft law (Section 5).

Further to this, Erdenedalai highlighted that, on 1 July 2021, the Parliament's Standing Committee on Security and Foreign Policy voted in favour of discussing the draft law.

If adopted, the draft law will enter into effect on 1 November 2021.
