Minnesota: Bill for Minnesota Consumer Data Privacy Act introduced to Senate

Senate Bill 2915 for the Minnesota Consumer Data Privacy Act was introduced and read for the first time, on 15 March 2023, in the Minnesota State Senate, and thereafter referred, on the same date, to the Commerce and Consumer Protection Committee. In particular, the bill would set out various obligations for covered entities that intend to process consumer personal information, establish consumer personal data rights, and provide enforcement authority to the Minnesota Attorney General.

Furthermore, the bill provides numerous definitions and stipulates that controllers must conduct, document, and maintain a data privacy and protection assessment that describes the policies and procedures adopted to comply with the bill.

Lastly, the bill is a companion bill to House Bill 2309, and would take effect on 31 July 2024.

Bill re-referred to Judiciary and Public Safety Committee

On 7 March 2024, the Minnesota Committee on Commerce and Consumer Protection amended and recommended the passage of the bill. On the same day, the Committee re-referred the bill to the Judiciary and Public Safety Committee.

On 21 March 2024, the bill was amended by the Senate Commerce and Consumer Protection Committee and re-referred to the State and Local Government and Veterans Committee.

On 8 April 2024, the bill was recommended to be passed as amended by the Minnesota Senate State and Local Government and Veterans Committee and re-referred to the Commerce and Consumer Protection Committee.

Bill included in omnibus bill and returned to Senate with amendments

On 13 May 2024, Senate Bill 4942 Omnibus Agriculture, Commerce, Energy, Utilities, Environment and Climate supplemental appropriations, containing the bill, was returned to the Senate from the House with amendments. Previously, the bill passed its third reading in the Senate on 6 May 2024.

Omnibus bill repassed as amended by Conference

On 19 May 2024, Senate Bill 4942 Omnibus Agriculture, Commerce, Energy, Utilities, Environment and Climate supplemental appropriations, containing the bill, was repassed as amended by Conference and will now be sent to the Governor.

UPDATE (24 May 2024)

Omnibus bill approved by Governor

On 24 May 2024, Senate Bill 4757, a bill for an act relating to commerce, containing the Minnesota Consumer Data Privacy Act (the Act), was approved by the Governor.

The Act will become effective on 31 July 2025, and will be enforced by the Minnesota Attorney General. The Act does not provide for a private right of action.
