Mexico: INAI adopts interpretation criteria for personal data law

The National Institute for Access to Information and Protection of Personal Data ('INAI') published, on 7 February 2023, the agreement through which it had approved, on 25 January 2023, the criteria for interpretation pursuant to Article 199 and 200 of the General Law on Transparency and Access to Public Information of 4 May 2015, as amended, and Articles 144 and 145 of the Federal Law on Protection of Personal Data Held by Private Parties ('the Law'). In particular, the interpretation criteria pursuant to Articles 144 and 145 of the Law are identified through headings and control codes, and cover, among others, the obligation to process requests that involve the exercise of data subjects' rights.

Notably, the agreement provides that the interpretation criteria shall constitute guidelines for private individuals, whether natural persons or private legal entities, for the purposes of the application of the Law.
