Lower Saxony: LfD Niedersachsen updates website consent guidelines
The Lower Saxony data protection authority ('LfD Niedersachsen') published, on 30 September 2022, an update to its guidelines on data protection-compliant consent on websites and requirements for consent layers, in acknowledgement of the increasing complexity of the design and implementation of consent layers on websites. In particular, the LfD Niedersachsen stated that the guidelines are aimed at website operators that use cookies and more generally for the integration of third-party service providers on websites where consent of website users is required, such as service providers for analysis, marketing, tracking, video, image optimisation, and push message and survey services. More specifically, the guidelines address, among other things, the following:
- requirements for data protection-compliant consent;
- revocation of consent; and
- obtaining consent from minors.
