Italy: Garante issues opinion on draft whistleblowing decree
The Italian data protection authority ('Garante') announced, on 24 January 2023, in its monthly newsletter, that it had issued its opinion on the draft legislative decree implementing Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019, concerning the protection of persons who report violations of EU law ('the Whistleblowing Directive'). In particular, the Garante noted that the draft legislative decree implemented almost all feedback that had been previously provided by the Garante to the Government, with particular regard to the notion of violation, the confidentiality obligations, and the revision of the maximum retention period for the records.
