Italy: Decree on transparent and predictable working conditions published in Official Gazette

Decree No.104 of 2022 ('the Decree') on the Implementation of the Directive on transparent and predictable working conditions in the European Union (Directive (EU) 2019/1152) was published in the Official Gazette on 27 June 2022 and shall come into force on 13 August 2022. In particular, Article 1 of the Decree states that its aim is to regulate the right to information in connection to essential elements of the employment relationship.

Furthermore, Chapter 2 of the Decree specifically sets out provisions regarding information on the employment relationship. Notably, Article 4(8)(b)(1) of the Decree outlines the information that must be kept by employers and made accessible to employees, as well as an obligation on employers to retain proof of transmission or receipt of such information. Additionally, Article 4(8)(b) of the Decree provides that employers are required to inform employees of the use of automated decision-making or automated monitoring systems designed to provide information relevant to recruitment or assignment, management or termination of the employment relationship, the assignment of tasks or duties, as well as indications concerning the fulfilment of contractual obligations of workers. Moreover, Article 4(8)(b)(2) of the Decree outlines further information that employers are required to provide employees prior to the commencement of work.
