International: ITA updates FAQs on Privacy Shield, remains committed to ensure international data flows
The U.S. Department of Commerce's International Trade Administration ('ITA') updated, on 31 July 2020, its frequently asked questions ('FAQs') in relation to the EU-U.S. Privacy Shield framework ('the Privacy Shield'), following the Court of Justice of the European Union's judgment in Data Protection Commissioner v. Facebook Ireland Limited, Maximillian Schrems (C-311/18). In particular, the ITA noted that the judgment does not relieve participants in the Privacy Shield of their obligations under the framework and that the US remains committed to working with the EU to ensure continuity in transatlantic data flows and privacy protections. Furthermore, the ITA highlighted that the continued participation in the Privacy Shield demonstrates a serious commitment to protect personal information and that it continues to administer the program, including processing submissions for self-certification and re-certification to the Privacy Shield and maintaining the Privacy Shield List.
