Indonesia: Kominfo releases statement in support of ASEAN MCCs

On August 30, 2023, the Ministry of Communication and Information (Kominfo) issued a statement in support of the Association of Southeast Asian Nations (ASEAN) Model Contractual Clauses for cross-border data transfers (ASEAN MCCs).

According to the Minister of Kominfo, Budi Arie Setiadi, at the ASEAN level, Indonesia supported the initiative to further discuss the joint guide on MCCs for data transfer use cases and noted that it will help in the implementation of the ASEAN MCCs that Indonesia supported. Budi further noted that the borderless nature of the internet and cross-border data transmission requires regulation at the global level. In particular, Budi outlined a need for conditions for managing the protection of personal data under the Personal Data Protection Law (PDPL) to align it with global standards. Furthermore, Budi stated that Kominfo advocated for discussions on the common understanding regarding the values ​​of cross-border data flows to accommodate the values ​​of fairness, lawfulness, and transparency at international forums.
