Indonesia: Government ratifies draft law amending Electronic Information Law

On December 5, 2023, the Ministry of Communication and Information (Kominfo) announced that the Government of Indonesia ratified the draft law concerning the second amendment to Law No. 11 of 2008 on Electronic Information and Transactions, as amended by Law No. 19 of 2016 on the Amendment to Law No. 11 of 2008 on Electronic Information and Transactions (the Electronic Information Law). 

In particular, Kominfo stated that several Articles were refined, including:

  • electronic evidence (Article 5);
  • electronic certification (Article 13);
  • electronic transactions (Article 17);
  • prohibited acts (Articles 27, 27(a), 27(b), 28, 29, and 36);
  • criminal provisions (Articles 45, 45(a), and 45 (b);
  • the role of the Government (Article 40);
  • the authority of civil servant investigators (Article 43);
  • child protection in the implementation of electronic systems (Article16(a)(b); and
  • international electronic contracts (Article 18(a)).
