Indiana: Senate Bill on consumer data protection introduced to State Senate

Senate Bill 5 on consumer data protection was introduced, on 9 January 2023, to the Senate Committee on Commerce and Technology. In particular, the bill would, among other things, provide for some responsibilities of controllers of consumers' personal data, define the roles of controllers and processors with respect to a consumer's personal data, and establish certain requirements for data protection assessments by controllers of consumers' personal data. More specifically, the bill would provide for consumer rights, such as the right of access, deletion, correction, and to opt-out of the sharing or sale of personal information.

Lastly, the bill would establish the authority of the Attorney General to investigate and enforce suspected or actual violations of its provisions.

The bill has been adopted, on 30 January 2023, by the Committee on Commerce and Technology, as amended by the Committee, by a majority vote.

Consumer data protection bill undergoes second reading in Senate

The bill underwent a second reading, on 7 February 2023, in the Indiana State Senate. In particular, the Senate had also voted on amendments introduced to the bill by the Committee on Commerce and Technology and engrossed the approved amendments.

The bill was read for the third time, on 11 April 2023, and passed by the House of Representatives, in a unanimous vote. In particular, the bill was previously recommended for passage with amendments by the Committee on Judiciary before it was read for the second time and engrossed by the House on 10 April 2023.
