India: DSCI publishes paper on privacy at work

On March 19, 2024, the Data Security Council of India (DSCI) announced that it published a paper on privacy in the workplace. The paper aims to shed light on the emerging trends and concerns with regard to the right to privacy in the context of employment.

Importantly, the DSCI notes that the scope of the paper is not limited to traditional employer-employee relationships, and other types of economically beneficial engagements, such as those involving gig workers or freelance service providers connected via digital platforms are also discussed. The paper includes recommendations, along with relevant case laws for data processing at various stages of employment:

  • pre-employment stage - which includes advertising, interview stage, and background verification;
  • during the course of employment;
  • outsourcing;
  • cessation of employment; and 
  • processing of personal data of former employees.
