India: ASCI publishes white paper on generative AI and advertising

On August 1, 2023, the Advertising Standards Council of India (ASCI) published a white paper titled 'Generative AI and Advertising - Opportunities, Risks and Best Practices' in collaboration with Khaitan & Co. In particular, the white paper discusses the legal implications and key challenges of using generative artificial intelligence (AI) in advertising and marketing and provides businesses with considerations and best practices to evaluate before deploying generative AI for advertising.

More specifically, the white paper discusses, among other things, the different applicable laws, the intersection of consumer protection and generative AI, and key risks, including, among others, AI bias, privacy concerns, creative displacement, and copyright concerns. It also proposes solutions for risk mitigation.
