Hesse: HBDI issues handout on political campaign advertising

The Hessen data protection authority ('HBDI') published, on 9 February 2023, a handout on data protection in the context of election and voting advertising practices. In particular, the HBDI stated that, in the run up to elections, it is common for citizens to be contacted by political parties and targeted with personalised advertising and, as such, its handout aims to clarify to both parties and citizens how such practices may be conducted in line with data protection law.

In this regard, the handount addresses, among other things, how personal data can be collected and used lawfully in the context of political campaign advertising, considerations for processing personal data involving political opinions and use of election campaign apps, as well as applicable data subject rights.
