Hawaii: House Bill on consumer data protection introduced, passes first reading

House Bill 1497 for An Act Relating to Consumer Data Protection was introduced, on 20 January 2023, to the Hawaii State Legislature and passed first reading on 23 January 2023. In particular, among other things, the bill would establish a framework to regulate controllers and processors' access to personal consumer data.

Moreover, the bill would introduce new consumer rights, such as the right to access, data portability, correction, deletion, and the right to opt out of the processing of the personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions made by the controller. In addition, HB 1497 would establish that a violation constitutes an unfair method of competition and unfair and deceptive acts or practices in the conduct of any trade of commerce, and would provide for a private right action to consumers whose rights are violated.

Notably, the bill is a companion bill to Senate Bill 1110 which was introduced, on 20 January 2023, to the Hawaii State Senate.

The bill was recommended, on 2 February 2023, to be passed by the Higher Education & Technology Committee with amendments.

Committee passes consumer data protection bill

The bill was passed, on 6 February 2023, by the Higher Education & Technology Committee with amendments and thereafter referred, on the same date, to the Commerce and Consumer Protection Committee. In particular, the bill aims to establish a framework to regulate controllers and processors' access to personal consumer data, among other things.
