Guernsey: ODPA publishes data collection guidance

On May 24, 2024, the Office of the Data Protection Authority (ODPA) published its latest data collection guidance. The ODPA stated that the guidance is meant to help organizations collect data from individuals in a way that complies with data protection principles. The guidance outlines the seven data protection principles and encourages organizations to refer to sections 31 and 32 of the Data Protection (Bailiwick of Guernsey) Law, 2017 (the Law) to ensure a complete understanding of compliance requirements. The ODPA stated that proper data collection is a key component for compliance with data protection laws and those same principles should be applied throughout the data lifecycle.

The ODPA also highlighted that if an organization processes personal data, there is a legal obligation to ensure the organization is registered with the ODPA.
