Guernsey: ODPA outlines data protection vision

On January 31, 2024, the Office of the Data Protection Authority (ODPA) announced its data protection vision for Guernsey which is embracing compliance and elevating confidence. In particular, the Bailiwick’s new Data Protection Commissioner, Brent Homan, detailed that the vision involves a strategy that is seamlessly aligned with the ODPA's Strategic Plan supported by the following pillars:

  • balance: in ensuring the right compliance tool is selected for the right situation;
  • trust: earned by demonstrating integrity, accountability, and transparency; and
  • partnership: both with those being served, as well as regulatory counterparts.

Regarding challenges, the ODPA noted the following:

  • promoting proactive compliance to address any residual attitude that compliance is simply a nuisance and legal obligation to be checked off;
  • breach risks which disproportionately injure Guernsey's residents; and
  • technological innovation involves unprecedented risks to individual's fundamental rights and freedoms.

Furthermore, the ODPA confirmed that it will work closely with other digital market regulators in the Channel Islands to tackle common challenges and increase participation in international networks and where issues align, join global collaborative enforcement efforts.
