Guernsey: ODPA issues press release on the use of dark patterns in gambling sector

On August 9, 2024, the Office of the Data Protection Authority (ODPA) issued a press release regarding its discovery of dark patterns that were detected in the gambling sector. The ODPA stated the results were generated from the recent Global Privacy Sweep. Specifically within the gambling sector, the ODPA stated that it reviewed 19 gambling sites and found indicators of dark patterns in all sites. The dark patterns discovered included:

  • lack of privacy settings in 42% of cases;
  • most sites had a privacy policy however, they were found to be lengthy and complex; and
  • in many cases, it was more difficult to delete an account than to create an account.

The ODPA stated that it has begun coordination with regulatory counterparts and reached out to organizations within the gambling industry to share and address concerns.
