Greece: Whistleblowing law adopted and published in Official Gazette

On November 11, 2022, the Hellenic Parliament adopted Law 4990/2022, which transposes the Whistleblowing Directive into Greek law. The whistleblowing law was published in the Official Gazette and entered into force on the same date.

What is the scope of the whistleblowing law?

The whistleblowing law aims to establish a system of both internal and external reporting of violations of EU law, the protection of individuals reporting such violations, the procedure for submitting, receiving, and monitoring reports, and the sanctions imposed in the event of a violation of the whistleblowing law.

How long do companies have to comply?

The whistleblowing law provides that:

  • private sector enterprises with 50-249 employees must comply with the obligation to establish an internal reporting channel, in accordance with Article 9 of the whistleblowing law, by December 17, 2023; and
  • private sector enterprises with more than 249 employees and public sector bodies must comply with the obligation to establish an internal reporting channel, in accordance with Article 8 of the whistleblowing law, within six months from its entry into force.
