Germany: Government adopts draft law implementing NIS 2 Directive

On July 24, 2024, the Government adopted the draft law implementing the requirements of the directive on measures for a high common level of cybersecurity in the Union (the NIS 2 Directive). The NIS 2 Directive imposes new and enhanced cybersecurity-related obligations on companies and other private or public entities, and EU Member States must implement it into local law by October 18, 2024.

Next steps

The draft law will now be examined by the 16 federal states after which the draft law will be discussed in Parliament (Bundestag). Post the approvals from the Bundestag, the draft law must be signed into law by the Federal President and will become effective on the date of its publication in the Federal Law Gazette.

You can read the Government version of the draft law here and track its progress here, both only available in German.
