Germany: Bundestag Legal Committee approves amendments to draft Whistleblowing Protection Act

The German Parliament ('Bundestag') announced, on 14 December 2022, that its Legal Committee adopted, with amendments, the draft Whistleblowing Protection Act ('HinSchG'), following the approval by the Federal Cabinet of Germany, in July 2022, and the Federal Council's ('Bundesrat') opinion, issued in September 2022. In particular, the Bundestag highlighted that the amendments adopted include:

  • the extension of the scope of application of the draft HinSchG to reports of statements by civil servants that constitute a violation of the duty of loyalty to the German Constitution; and
  • the handling of anonymous reports, whose processing becomes mandatory, rather than optional, for reporting offices.
