Germany: BfDI summarizes key provisions of EU AI Act

On July 16, 2024, the Federal Commissioner for Data Protection and Freedom of Information (BfDI) published a summary of the notable provisions of the EU Artificial Intelligence Act (the EU AI Act) from a data protection perspective.

Notably, the BfDI stated, among other things, that the General Data Protection Regulation (GDPR) is technology-neutral and applies to artificial intelligence (AI) systems, and this will continue to be the case with the EU AI Act which supplements existing legal requirements. Due to the high complexity of AI systems and the lower level of traceability and transparency compared to conventional software, the AI-specific requirements of the EU AI ​​Act are required for the protection of fundamental rights. The data protection supervisory authorities are also given new tasks and powers through the EU AI Act.
