Fujian: Communications Administration launches special action to rectify apps infringing user's rights
The Ministry of Industry and Information Technology of the People's Republic of China ('MIIT') announced, on 12 May 2021, that the Fujian Provincial Communications Administration had issued a notice on launching a special rectification action for Fujian apps infringing users' rights and interests from 26 April 2021 to 31 December 2021. In particular, the MIIT noted that the special action includes three links: enterprise self-test, random tests by the administrative bureau, and retest as well as the disposal of apps.
Specifically, the MIIT noted that on 30 May 2021, relevant apps will be required to carry out self-tests and self-examinations based on relevant standards such as the Regulations on the Scope of Necessary Personal Information for Common Types of Mobile Internet Applications and rectify violations in a timely manner. Further to this, the MIIT noted that starting from June the Fujian Administration will entrust a third-party to conduct random tests on apps, and apps that do not comply with the test results will be notified and must complete the rectification and submit a rectification report within 10 days.
