France: CNIL publishes assessment of cookie action plan
The French data protection authority ('CNIL') published, on 15 May 2023, an assessment of the impact of its cookie action plan. In particular, CNIL highlighted that it launched its action plan on cookies in 2020, alongside guidelines on the use of cookies and other trackers in October 2020. More specifically, CNIL outlined that following 31 March 2021, where the guidelines and recommendations on the use of cookies and other trackers entered into force, it has sent 94 formal notices to non-compliant organisations, and that sanctions have been issued against organisations, such as Google LLC, Amazon Europe Core Sarl, and Facebook Ireland Limited (since renamed Meta Platforms Ireland Limited as of 4 January 2022), for non-compliance with cookies requirements.
In addition, CNIL noted that eight sanctions were imposed between 2020 and 2022 relating to the use of cookies, owing in general to a lack of information regarding the use of cookies, the deposit of cookies without prior consent, the failure of the refusal of cookies mechanism, or the difficulty of refusing cookies with the same ease as accepting them.
