Florida: Bill creating Digital Bill of Rights introduced to Senate

Senate Bill 262 creating the Florida Digital Bill of Rights was filed, on 3 March 2023, with the Florida State Senate and thereafter, on 6 March 2023, referred to the Committee on Commerce and Tourism. In particular, the bill outlines definitions, including biometric information, controller and processor, deidentified, genetic information, as well as personal information. More specifically, the bill outlines controller obligations for the collection of consumer data, including specific requirements for the collection of consumer personal data without authorisation, as well as requiring controllers that collect personal information to implement reasonable security procedures and practices to protect such information.

In addition, the bill stipulates that controllers that collect a consumer's personal information disclose certain information regarding their data collection and selling practices to the consumer at or before the point of collection, specifying that such information may be provided through a general privacy policy or through a notice informing the consumer that additional specific information will be provided upon request. Furthermore, the bill outlines consumer privacy rights, including a right to request deletion or correction of certain personal information and a right to opt out of the sale or sharing to third parties.
