EU: IAB Europe lodges request for interim measures in TCF case

Interactive Advertising Bureau ('IAB') Europe announced, on 10 February 2023, that it had lodged a formal request for interim measures with the Belgian Market Court ('the Market Court'), in relation to the Transparency & Consent Framework ('TCF') case, following the Belgian Data Protection Authority's ('Belgian DPA') approval of IAB Europe's action plan. In particular, IAB Europe explained that the Court of Justice of the European Union ('CJEU') will not have rendered its judgment on the request for preliminary ruling by the Market Court before the expiry of the six-month deadline to implement the action plan.

In light of the above, IAB Europe sought interim measures to prevent the Belgian DPA from enforcing the execution of the changes to the TCF that may need to be rolled back when the CJEU's ruling is rendered.
