EU: IAB Europe comments on Belgian DPA's investigation of Transparency and Consent Framework

The Interactive Advertising Bureau ('IAB') Europe announced, on 16 October 2020, that it has been informed by the Belgian Data Protection Authority ('Belgian DPA') that they have completed an investigation into IAB Europe's privacy and data protection practices in connection with its role as the managing organisation of the Transparency and Consent Framework ('TCF'). In particular, IAB Europe outlined that the Belgian DPA's report represents the preliminary views of the Belgian DPA's investigations unit and has no binding effect with regard to any breach of the law by IAB Europe. In relation to a number of alleged compliance issues that stem from IAB Europe's role as managing organisation of the TCF, IAB Europe highlighted that it respectfully disagrees with the Belgian DPA's apparent interpretation of the law, pursuant to which IAB Europe is a data controller in the context of publishers' implementation of the TCF.

Moreover, IAB Europe noted that the TCF is a voluntary standard whose purpose is to assist companies in the digital advertising ecosystem with their compliance efforts with EU data protection law, as well as that its policies do not assist or seek to assist the processing of special categories of data. Lastly, IAB Europe recalls that it will be engaging with the Belgian DPA over the coming months as its services conduct evaluations on the merits of the report.
