EU: EDPB publishes guidelines on right of access

The European Data Protection Board ('EDPB') announced on Twitter, on 28 January 2022, that it had published its Guidelines 01/2022 on data subject rights - Right of access ('the Guidelines') as adopted on 18 January 2022 in its 59th plenary session. In particular, the EDPB stated that the Guidelines aim to analyse the different aspects of the right of access and to provide more precise guidance on how the right of access has to be implemented in different situations.

In addition, the EDPB highlighted that, among others, the Guidelines provide clarifications on the scope of the right of access, the information the controller has to provide to the data subject, the format of the access request, the main modalities for providing access, and the notion of manifestly unfounded or excessive requests.

Furthermore, the EDPB noted that the Guidelines will be subject to public consultation from 28 January to 11 March 2022.
