EU: EDPB issues opinion on draft decision of IDPC regarding the approval of requirements for accreditation of certification body
The European Data Protection Board ('EDPB') adopted, on 30 November 2021, Opinion 37/2021 on the draft decision of the Maltese Office of the Information and Data Protection Commissioner ('IDPC'), regarding the approval of the requirements for accreditation of a certification body pursuant to Article 43(3) of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'). In particular, the EDPB highlighted that the IDPC submitted its draft decision containing the accreditation requirements for a code of conduct monitoring body to the EDPB, requesting its opinion pursuant to Article 64(1)(c) of the GDPR, for a consistent approach at the Union level, and that the decision on the completeness of the file be taken on 5 October 2021. Moreover, the EDPB noted that the draft accreditation requirements of the IDPC may lead to an inconsistent application of the accreditation of certification bodies and highlighted a number of changes that need to be made.
