EU: EDPB to develop guidance with Commission on GDPR and DMA interplay
On September 10, 2024, the European Data Protection Board (EDPB) announced that it has agreed to work together with the European Commission to clarify and give guidance on the interplay between the Digital Markets Act (DMA) and the General Data Protection Regulation (GDPR).
The EDPB outlined that the work will focus on the applicable obligations to digital gatekeepers under the DMA to develop a coherent interpretation of the DMA and GDPR while respecting each regulator's competencies in areas where the GDPR applies and is referenced in the DMA.
Furthermore, the EDPB clarified that the DMA established a High-Level Group, which includes the Commission and representatives from the EDPB and European Data Protection Supervisor (EDPS) to provide the Commission with advice and expertise to ensure coherent implementation of the DMA and other sectoral regulations.
