EU: EDPB adopts opinions on draft decision of LfDI Baden-Württemberg on Luxoft Group controller and processors BCR

The European Data Protection Board ('EDPB') adopted, on 16 February 2021, Opinions 09/2021 and 08/2021 on the Baden-Württemberg data protection authority ('LfDI Baden-Württemberg') draft decision on the controller and processor Binding Corporate Rules ('BCRs') of Luxoft Group. In particular, the EDPB found that the draft decision of LfDI Baden-Württemberg can be adopted as it is, because both controller and processor draft BCRs of the Luxoft Group contain appropriate safeguards to ensure that the level of protection of natural persons under the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR') will not be undermined when personal data will be transferred to and processed by members of the same group based in third countries.
